GAUTENG HIGH COURT MANDATORY MEDIATION PROJECT
On 22 April 2025, the Gauteng Division of the High Court took a landmark step by publishing a Mediation Directive and Protocol (Mediation Directive). This Mediation Directive is the first of its kind and signals a pivotal shift in the South African legal landscape by prioritising mediation as a dispute resolution mechanism.
The mandatory referral of civil matters to mediation will help alleviate the pressure currently experienced by the courts and foster more collaborative outcomes.
The Mediation Directive applies with effect from 22 April 2025 to all civil actions, including but not limited to personal injury claims and Road Accident Fund (RAF) matters. By focusing on these high-volume matters, the Gauteng High Courts aim to promote efficiency and access to justice by ensuring that only the matters truly in need of judicial intervention ultimately appear on the trial rolls.
We at Mediation in Motion Mediators (MiMM), are proud to have had a few of the MiMM Executive Committee Members participate and engage in the various consultative processes that ultimately led to this Mediation Directive and Protocol. The conversations, led by the leadership of the Gauteng Judiciary, ultimately focused on addressing the pressure currently experienced by the courts and fostering more collaborative outcomes through facilitative mediation. MiMM’s active and ongoing involvement in these crucial discussions highlight our organisation’s commitment to advancing professional mediation practices in South Africa and ensuring that our mediators’ voices are heard in shaping the policies that impact the justice system.

To support the implementation of the Mediation Directive, MiMM has developed a structured process. Whether you’re a mediator looking to participate in the initiative or a party to a case preparing for mediation, it’s essential to understand the steps involved. Apply to Join MiMM’s Panel for the Gauteng High Court Project
MiMM is a Recognised Mediation Organisation (RMO) in terms of the Mediation Directive. MiMM is inviting its members to apply for participation in the Gauteng High Court Mandatory Mediation Project as a member of MiMM’s panel.
To initiate the application process, MiMM silver and bronze members must complete the application form for their eligibility to be considered. Once a mediator is approved to participate on MiMM’s panel, MiMM will issue the relevant certificates and letters to the mediator confirming his/her qualification, skills and experience as is required for participation in the Gauteng High Court’s Project.

Meeting the eligibility criteria is essential for receiving a recommendation, and this is not just based on your payment to the membership level. It is vital for us to ascertain and vouch for the experience and competence of the mediators we put forward for the panel.
